Exemption application and issues papers9 Aug 2019

On 2 July 2019, Viterra provided a written application to the ACCC seeking to be determined an exempt service provider of port terminal services provided by means of all six of their port terminal facilities located in South Australia.

On 9 August 2019, the ACCC released an issues paper to commence a public consultation process on the application submitted by Viterra. Eight submissions were published in response to the paper (see below).

Viterra provided various supplementary materials since stakeholder submissions were received in October 2019. In order to give stakeholders an opportunity to comment on these new materials the ACCC released a supplementary issues paper on 25 May 2020. A further three submissions were received from stakeholders in response to the supplementary issues paper.

Supplementary information provided by Viterra

After releasing the initial Issues Paper (August 2019) the ACCC received a range of further information from Viterra (between November 2019 and March 2020), largely in response to information requests and ongoing discussions with/from the ACCC.

Subsequent to the release of the Draft Determinations, Viterra provided updated 2019-20 capacity figures as part of its response to the Draft Determinations. The changes reflect the release of additional short term capacity since Viterra’s original response to the information request (and other minor amendments). The updated 2019-20 capacity figures are presented in the document titled:

Following the release of the Final Determinations for IHB, OHB, Port Giles and Wallaroo, Viterra provided 2020-21 and 2021-22 capacity figures for Port Lincoln and Thevenard in response to an ACCC information request. These capacity figures are presented in the document titled:
