Position paper23 May 2014

On 23 May 2014, the ACCC released a position paper to assist interested parties prepare their submissions.

Background

The ACCC has commenced three public inquiries into making final access determinations for a number existing declared services. Specifically, it is holding inquiries into making final access determinations for:

  • fixed line services and the wholesale ADSL service
  • mobile terminating access service (MTAS)
  • domestic transmission capacity service (DTCS)

Given these inquiries will cover a number of related issues regarding non-price terms and conditions and supplementary pricing issues, the ACCC considers there are benefits in conducting a combined consultation process on these issues.

Due to the complexity and number of the issues involved in determining the primary prices for each of the declared services, the ACCC has decided to consult separately on these issues. Further information on these consultations can be found by visiting the respective project pages.

Final access determination inquiries position paper

The ACCC began consultation on non-price terms and conditions and supplementary pricing issues for a number of related declared services:

The paper sought submissions on a number of supplementary pricing and non-price terms and conditions issues for the relevant final access determination inquiries.

The ACCC invited submissions from interested parties by 5 pm 15 July 2014.

Submissions

Supplementary submissions

On 23 September 2014 Telstra made a supplementary submission to the ACCC’s position paper.

On 13 October 2014, Telstra made a submission on the final access determination price and non-price terms and conditions for the wholesale line rental (WLR) service and local call service (LCS) in CBD areas. Telstra’s submission can be found on the primary prices inquiry webpage.

On 25 November 2014, iiNet made a submission in response to Telstra's submission of the 13 October 2014. On 19 December 2014, Macquarie Telecom made a submission in response to Telstra's submission of the 13 October 2014. iiNet's and Macquarie's submissions can be found on the primary prices inquiry webpage.

Confidential submissions

The ACCC received confidential submissions from Optus, Telstra, Vocus and Vodafone. An overview of the submissions received is provided, by stakeholder, along with a designated contact person.
