Notice under subsection 152BCK(3) of the Competition and Consumer Act

Access determination inquiries are generally required to be completed within 6 months, under subsection 152BCK(2) of the Competition and Consumer Act 2010.

However, the ACCC can extend or further extend the duration of the inquiry by 6 months at a time, provided we publish a notice on the website indicating why the ACCC has not been able to make a decision within that timeframe.

Due to the range of complex issues, particularly relating to pricing methodology and a potential exemption framework, the ACCC has decided to extend the SBAS final access determination inquiry by 6 months in accordance with subsection 152BCK(3) of the Competition and Consumer Act 2010. The existing 6-month timeframe would not have enabled adequate consultation to be undertaken. 

Accordingly, the inquiry is now due to be completed on or before 19 July 2022.
