On 6 August 2009, the ACCC released its draft decision not to accept ABB Grains Ltd's (ABB) Access Undertaking.

Revised access agreement and port terminal services protocols
During the course of the assessment process, ABB also provided proposed standard terms and conditions of access to its port terminals services.
A revised version of ABB's Port Loading Protocols was received on 19 August 2009.

The ACCC received the following submissions from ABB in relation to the ACCC's draft decision on its proposed Undertaking.
In response to the AGEA submission of 15 September 2009, the ACCC received a further submission from ABB in relation to the proposed provision of the Undertaking by AusBulk Limited instead of ABB.
