Record keeping rule 20148 Sep 2014

The ACCC released the NBN Services in Operation record keeping rule and an explanatory statement on 8 September 2014. The rules take effect from 1 October 2014 and expire on 30 September 2017.

Extensions under rule 12 of the record keeping rule

Rule 12 of the record keeping rule provides the ACCC with the ability to extend the record keeping rule by giving written notice to NBN Co.

Following NBN Co’s release of new access services, the ACCC has provided written notice to NBN Co to extend the record keeping rule on:

  • 12 February 2015 to cover the commercial launch of NBN Co’s Fibre-to-the-Building (FTTB) network access services
  • 20 October 2015 to cover the commercial launch of NBN Co’s Fibre-to-the-Node (FTTN) network access services
  • 4 July 2016 to cover the commercial launch of NBN Co’s Satellite network and Hybrid Fibre Coaxial (HFC) network access services.

Prior to these extensions of the record keeping rule, NBN Co was only required to maintain records in relation to Fibre-to-the-Premises (FTTP), fixed wireless and interim satellite services.

Extension of the record keeping rule to capture new access services or products as they are launched commercially by NBN Co will ensure that the same information is obtained for each new service or product.
